ENTERTHEKULT — TERMS OF SALE

1. About These Terms of Sale
1.1 These Terms of Sale (“Terms”) apply when you purchase products from ENTERTHEKULT through our website, Instagram, WhatsApp, direct invoice, payment link, or any official ENTERTHEKULT sales channel (“Platform”).
1.2 By purchasing any products from ENTERTHEKULT (“Products”), you confirm that you agree to these Terms.
1.3 These Terms should be read together with any additional product-specific terms, release conditions, raffle conditions, pre-order terms, or promotional conditions communicated by ENTERTHEKULT.
2. About Us
2.1 ENTERTHEKULT is a South African sneaker and merchandise collective specialising in curated footwear, apparel, accessories, and limited-release products.
2.2 ENTERTHEKULT operates within South Africa and delivers nationally using Aramex, including selected international deliveries to Botswana and Lesotho.
2.3 For customer support, order assistance, or disputes, customers may contact ENTERTHEKULT through our official communication channels listed on our Platform.
3. Orders & Acceptance
3.1 All orders are subject to availability and acceptance by ENTERTHEKULT.
3.2 Your order is only confirmed once:
payment has been successfully received; and
you receive confirmation from ENTERTHEKULT.
3.3 ENTERTHEKULT reserves the right to refuse, limit, or cancel orders at our discretion, including where:
Products become unavailable;
pricing errors occur;
fraudulent or suspicious activity is suspected;
payment cannot be verified;
delivery locations fall outside our shipping coverage.
3.4 If an order is cancelled after payment has been received, a refund will be processed within a reasonable period.
4. Product Availability & Limited Releases
4.1 Certain Products sold by ENTERTHEKULT may be limited-release, exclusive, vintage, collectible, or sourced from third-party resellers.
4.2 Availability is never guaranteed, even where Products appear available online.
4.3 ENTERTHEKULT reserves the right to:
limit quantities per customer;
cancel duplicate or bulk orders;
restrict purchases suspected to involve bots, resellers, or fraudulent activity.
5. Pricing
5.1 All prices are listed in South African Rand (ZAR) unless otherwise stated.
5.2 ENTERTHEKULT may change pricing at any time without prior notice.
5.3 Prices displayed at checkout are the final applicable prices excluding any customs duties or import charges applicable outside South Africa.
5.4 Obvious pricing mistakes may be corrected even after an order is placed.
6. Payments
6.1 Payment must be made in full before Products are shipped or collected.
6.2 ENTERTHEKULT reserves ownership of all Products until payment has cleared in full.
6.3 We reserve the right to verify payments, identities, billing information, and transaction legitimacy before processing any order.
6.4 Fraudulent chargebacks, payment reversals, or unauthorised payment disputes may result in:
order cancellation;
account blacklisting;
legal action where applicable.
7. Authenticity
7.1 ENTERTHEKULT aims to supply authentic Products only.
7.2 Certain Products may be sourced through reseller networks, private suppliers, collectors, or third-party distributors.
7.3 Minor packaging damage, box wear, manufacturing inconsistencies, or age-related imperfections do not constitute defects.
8. Shipping & Delivery
8.1 ENTERTHEKULT delivers throughout South Africa using Aramex.
8.2 International delivery is currently available to:
Botswana
Lesotho
8.3 Delivery timeframes provided are estimates only and are not guaranteed.
8.4 ENTERTHEKULT is not liable for delays caused by:
courier delays;
customs clearance;
strikes;
weather conditions;
public holidays;
unrest;
force majeure events;
high order volumes.
8.5 Risk in the Products passes to the customer upon delivery to the provided address.
8.6 Customers are responsible for ensuring shipping details are accurate before checkout.
8.7 Additional customs duties, VAT, import taxes, or clearance charges for international deliveries are the responsibility of the customer.
9. Lost, Stolen or Damaged Parcels
9.1 ENTERTHEKULT is not responsible for parcels lost, delayed, stolen, or damaged after confirmed delivery.
9.2 Any delivery disputes must be reported within 48 hours of delivery confirmation.
9.3 ENTERTHEKULT will assist customers in opening courier investigations where applicable, but final courier outcomes remain outside our control.
10. Pre-Orders
10.1 Certain Products may be sold on a pre-order basis.
10.2 Estimated arrival dates for pre-orders are subject to supplier, logistics, and customs timelines and may change.
10.3 Delays to pre-orders do not automatically entitle customers to compensation.
10.4 ENTERTHEKULT reserves the right to cancel pre-orders and issue refunds where stock cannot be secured.
11. Returns, Refunds & Exchanges
11.1 Due to the limited and collectible nature of many Products sold by ENTERTHEKULT, all sales are generally final.
11.2 Returns or exchanges may only be accepted where:
the incorrect Product was supplied;
the Product is materially defective;
required under applicable South African consumer law.
11.3 Any return request must be submitted within 7 days of delivery.
11.4 Returned Products must:
be unworn and unused;
include original packaging;
include tags, accessories, and proof of purchase.
11.5 ENTERTHEKULT reserves the right to refuse returns where Products show signs of wear, damage, misuse, alteration, or tampering.
11.6 Customers are responsible for return shipping costs unless the error was caused by ENTERTHEKULT.
11.7 Shipping costs are non-refundable unless required by law.
12. Exchanges
12.1 Exchanges are subject to stock availability.
12.2 ENTERTHEKULT cannot guarantee size swaps for limited-release Products.
12.3 Exchange requests may be refused for exclusive or high-demand releases.
13. Product Images & Descriptions
13.1 Product images are for illustrative purposes only.
13.2 Colours, materials, textures, and packaging may vary slightly due to photography, monitor displays, supplier updates, or manufacturing variations.
14. Prohibited Conduct
14.1 Customers may not:
use bots or automated purchasing methods;
engage in payment fraud;
impersonate others;
misuse promotional codes;
attempt to disrupt releases or raffles.
14.2 ENTERTHEKULT reserves the right to cancel orders or restrict future purchases where prohibited conduct is suspected.
15. Limitation of Liability
15.1 ENTERTHEKULT shall not be liable for:
indirect or consequential losses;
loss of profit;
loss of business;
emotional distress;
delays outside our control.
15.2 Nothing in these Terms excludes rights granted under applicable South African consumer protection legislation.
16. Privacy
16.1 ENTERTHEKULT processes customer information in accordance with applicable South African privacy laws, including the Protection of Personal Information Act (“POPIA”).
16.2 Customer information may be used for:
order fulfilment;
customer communication;
fraud prevention;
delivery coordination.
17. Governing Law
17.1 These Terms are governed by the laws of the Republic of South Africa.
17.2 Any disputes arising from these Terms shall be subject to the jurisdiction of South African courts.
18. Changes to These Terms
18.1 ENTERTHEKULT reserves the right to update or amend these Terms at any time without prior notice.
18.2 The latest version of the Terms will always apply to new purchases.
